The appellate court decision arose from an urgent suit filed by the United Democratic Alliance (UDA) which is fielding Deputy President William Ruto as its presidential candidate. Speaking during a press conference on Monday, IEBC chairman Wafula Chebukati stated that “the manual register is usually used as a last resort, in case of failure of electronic gadgets at polling stations.”

Voting is taking place from 6 am to 5 pm at their local time. According to IEBC officials at Indangalasi Polling Centre, the KIEMS kit used was not yet configured leading to delays in voting in the station. He asked IEBC to drop the procedure and use what is stipulated in law to allow all the registered voters in the area to vote. This, he said had further slowed the exercise with voters who queued to vote as early as 3am still stranded at the polling stations. Prof Nyong’o said the technological hitch at several polling stations had affected voting in Kisumu, Siaya, Migori and Homa Bay counties with a good number of voters in the area yet to cast their votes.
