Why Ruto wants LSK out of presidential petition (The Standard)

The Law Society of Kenya filed an application to be joined in the presidential election petitions at the Supreme Court.

LSK wants to help the court with three issues concerning the meaning of the standard of proof in an election petition, the value of rejected votes in the presidential election, and the role of the IEBC commission in tallying, verification, and declaration of results. “The society wants to be joined as a neutral party because of the public interest involved in the dispute surrounding the presidential election,” the society said in the application filed by Kililo Advocates. The Law Society of Kenya filed an application to be joined in the petitions at the Supreme Court challenging the declaration of Deputy President William Ruto as president-elect. The UDA party leader also argues that by allowing the LSK to join the case as an amicus curiae (friend of the court), the court would be offending the rules governing the friends of the court. He has also indicated that including LSK in the case is unlikely to add any value to the outcome of the court. “The applicant has misrepresented material facts by pleading that the LSK has no connection to any party in this matter, which is FALSE, as the LSK is connected to the 2nd Petitioner,” Ruto’s affidavit reads in part.

Supreme Court petition chance to firewall democracy in Kenya (The Standard)

Going to the Supreme Court not only enriches our jurisprudence but also gives the judges the institutional confidence to be truly independent.

For many of us, our freedom to freely speak for our people is truly on the line. They are asking the Supreme Court to afford everyone a fair hearing in the spirit of our new Constitution and enabling laws. We shall be imploring the Supreme Court not to abandon us at the hour of need. Even when the decisions of the courts have not been in their favour in the past, they have expressed their honest displeasure without threatening to bring down the walls. The distress that accompanied the announcement got many Kenyans worried about their safety and security and it’s not difficult to see why. Going to the Supreme Court not only enriches our jurisprudence but also gives the judges the institutional confidence to be truly independent. The Azimio petition is not about Raila. The Supreme Court is one of them. Azimio's going to court shouldn’t be seen from the lens of settling a political dispute. The Judiciary can only be truly independent when the other two arms of government engage it with clean hands. But not everyone is happy with the court process. The Azimio petition has finally been admitted for hearing at the Supreme Court.
