(“ECP”), a registered investment adviser and financial planning firm located in New City, New York, was sentenced to 80 months in prison for participating in a conspiracy with her father, HECTOR MAY, the former president of ECP, to defraud certain investment advisory clients (the “Victims”) out of more than $11 million. In order to obtain money from the Victims’ securities accounts with Broker Dealer-1, MAY advised the Victims, among other things, that they should use money from those accounts to have ECP, rather than Broker Dealer-1, purchase bonds on their behalf.

§ 9-23-103(a)(2) and other contractually imposed restrictions currently listed in the Plans, the Interlocal Cooperative Agreement (the “Agreement”) between the Sports Authority, the City of Chattanooga (the “City”) and Hamilton County (the “County”), and the City’s Resolution No. It states the following: "Best interest of the state" for purposes of an extended plan term means an extended plan term or term extension is reasonably required for plan completion. § 9-23-104, no allocation of tax increment revenues shall be made with respect to any property for a period of more than twenty (20) years in the case of an economic impact plan unless both the Commissioner of the Department of Economic and Community Development and the Comptroller of the Treasury find that the use of tax increment revenues for such purposes is in the best interest of the State of Tennessee. To the extent the tax increment revenues exceed the amount needed to pay debt service on the Sports Authority Bonds, the usage of such excess is governed by Tenn. § 9-23-104, the Economic Impact Plans for the South Broad District (the "Plans") are in the best interest of the State of Tennessee. Perhaps the most prominent bone stuck in the throat of the comptroller’s office was its own inability to audit the finances of public authorities. Recommendations to the Charter Revision Committee need not be made by government offices alone. Deputy county comptroller Alicia DeMarco came armed with a list of preliminary recommendations organized by the comptroller’s office for the committee’s review. “We felt like there were certain positions, obviously, that should be restricted from outside employment due to actual or perceived conflicts of interest,” said DeMarco. The comptroller feels that the position of Commissioner of Finance should be banned from outside employment of any kind. And we had a favorable opinion that we did have audit authority. “I don’t know if you guys are all familiar with the [compensation review] committee, but they recently came out with recommendations to increase the elected officials’ salaries. There may be similar logic to spacing out any untimely opportunity to meddle with the charter. It’s theorized that cicadas, which share a similar time-line, stay underground as long as they do to avoid the predations of natural enemies. There’s little glory for the appointed commission members. Then the voters will have their say during the 2023 general election cycle. Led by chair Kathleen Mihm, the commission, with ample representation of experienced politicos, can be thought of as a think tank granted the power to decide what amendments or revisions to the charter are on or off the table.

"We're grateful that the comptroller has offered a favorable opinion of the proposed tax increment financing (TIF) district for the South Broad revitalization project," she said. It asked for a copy of the final contract lease be filed with the comptroller's office. The letter asked for inclusion of that restriction in future bond documents.
