Tanzania takes on Kenya with Sh271bn SGR link to DRC (Business Daily)

Kenya's plan to control East Africa's logistics corridor has been put to a fresh test after Tanzania moved to extend its standard gauge railway (SGR).

Later, we can think of upgrading the existing MGR via Nakuru to Kisumu and via Eldoret to Malaba,” Murkomen said in a statement on December 15. “We’re going to build a brand new [SGR line] from Kampala to Kasese. Road and Transport Cabinet secretary Kipchumba Murkomen recently said the Kenya Kwanza administration in partnership with the Chinese government is keen on extending the SGR from Naivasha’s Mai Mahiu to the border of Uganda through a five-year plan that will see the multibillion-dollar railway line run through Narok, Bomet, Nyamira, Kisumu, and finally Malaba. In 2014, the Government of Kenya entered into a tripartite agreement with the governments of Rwanda and Uganda to construct a standard gauge railway from Mombasa through Kampala Uganda to Kigali Rwanda. Analysts reckon that Tanzania’s signing of the contract with China Civil Engineering Construction Corporation and China Railway Construction Corporation gives Dar a fighting chance in the race to control the trade routes.

Multinationals battling court cases in Kenya (Business Daily)

Several multinationals are battling court cases in Kenya whose outcome is highly awaited this year because of the risks they carry on their operations.

The arbitration matter was later withdrawn according to court documents. He has sued French firm Cebra Healthcare and Lancet Service Company of South Africa, demanding his payout as a founder of the Kenyan wing of the laboratory firm, which returned a profit of Sh306 million in 2020 on sales of Sh1.6 billion. The association wants the court to interpret and determine whether sections 5(l), 32(3)(b), 32(4), 34(3)(b), 34(4)(5)(6), 36(1),48 (1) and 53 of the Tea Act is constitutional. The joint venture, however, did not include operations in South Africa. He says the post on Facebook profiled and accused him of associating with TPLF. The workers on their part argue that the petition is part of the wider plan by the company to frustrate their case in Scotland. He was employed as a moderator by Meta’s local outsourcing company — Samasource Kenya EPZ ltd. The company through its director, Bulent Gulabahar- lodged a complaint with the DCI and the DPP, accusing Nokia of using false information in a case that was pending before the ICC Court of Arbitration pitting the two firms. The company wants the court to issue a permanent injunction barring the former and current workers or their agents from proceeding with the cases in Scotland. The company with Scottish roots wants the court to issue a declaration that the Director of Occupational Health and Safety Services in Kenya is the one to deal with work injury claims arising within the country in line with Article 159 of the Constitution and Section 16 of the Work Injury Benefits Act. According to James Finlay, the decision of the workers to institute the proceedings before the Scottish Court of Sessions, alleging violation of their rights, is an affront to the constitution and the sovereignty of Kenya. A ruling on whether the case can proceed after Meta challenged the jurisdiction of the High Court to determine the matter will be made in February.

Armchair lessons for a more fulfilling year (Business Daily)

A new year is an end to a past most people want to forget and a beginning to endless possibilities that most people want to remember.

The truth is malleable, and many people are in the business of hammering the truth to suit their imagined realities. In the end, a new regime came to power. When the queen died, it was to many people, a sad thing. The frequency of previous strikes in one place is not a determining factor. Weeks after that regime came to power even before the ink on the assumption of office chatter dried, the queen of the United Kingdom died. You could be Morocco—a team nobody paid attention to before the start of the tournament—and walk all the way to the semi-finals. The other lesson here is that you make the rules(mostly). That the truth is fluid to so many people. You could be a tournament favourite and then fail to make it past the group stages. The most valuable lesson we could take from this event is that you could be anything you want. Maybe move houses, start new businesses, or chart a new financial path, but it has nothing to do with the calendar. It is a trick we all play ourselves into.

Mulwa holds a special place in the heart of practically all the students he’s ever taught at KU. Dance Centre Kenya’s Nutcracker ballet also worked with the live orchestra of Ghetto Classics conducted by Levy Wataka this year. For instance, Bhalla-Lucas may not consider herself a playwright, but her carefully-crafted psychological profiles of characters who were challenged emotionally during the pandemic were masterful, delicate, and deep. But in addition to all of these, there were also amazing shows based on sheer storytelling. We saw scads of comedy coming from the usual suspects, namely Heartstrings Entertainment and Crony Players as well as from Aperture Africa and the Man-Made Woman, Esther Kahuhi. It’s impossible to capture the totality of vibrant energy expressed on stage in 2022.

Intrigues behind the Fidelity Bank buyout revealed (Business Daily)

In the second quarter of 2016, Fidelity Commercial Bank was experiencing a worsening liquidity crisis.

In its defence, CBK says that it is not a party to the share purchase agreement between SBM and the former Fidelity shareholders. The multinational’s representatives added that Fidelity’s former owners were also informed of the status of the bank’s financial position as provided for in the agreement. In its 2017 annual report, SBM disclosed that it bought a 99.99 percent interest in Fidelity for a consideration of 35 Mauritian rupees (Sh100) “plus a contingent consideration.” SBM has not made any payment to the Khimji group in breach of their agreement, the plaintiffs say in the court papers. The legal battle will unravel the roles, claims and counterclaims by three key parties –SBM, former owners of Fidelity and the Central Bank of Kenya (CBK). The negotiations culminated in SBM’s buyout of Fidelity for Sh100 in a controversial transaction that is now before the High Court.

How January taxes will hit consumers, companies (Business Daily)

Kenyan businesses and consumers are staring at a fresh round of tax increases as measures approved in the 2022 Finance Act kick in this week.
